    The data controller is D.M.A. IMMOBILIARE SRL (P.I. IT02328210428), with registered office in Italy, via Piave 34, Senigallia (AN)

  2. PLACE OF DATA PROCESSING

    The treatments connected to the web services of this Site take place at the headquarters and/or offices of the D.M.A. IMMOBILIARE SRL, or at the headquarters and/or offices of other legal entities that may be appointed “Data Processors” and are handled by technical personnel in charge of processing.

  3. TYPES OF DATA PROCESSED

    Navigation data

    The IT systems and software procedures used to operate the Site acquire, during their normal operation, some personal data whose transmission is implicit in the use of Internet communication protocols. 

    • This is information that is not collected to be associated with identified interested parties, but which by their very nature could, through processing and association with data held by third parties, allow users to be identified.

  4. DATA PROVIDED VOLUNTARILY BY THE USER

    The optional, explicit and voluntary sending of e-mails to the addresses indicated on the Site involves the subsequent acquisition of the sender’s address, necessary to respond to requests, as well as any other personal data included in the message.

    The user assumes responsibility for the personal data of third parties published or shared through the use of the Site and guarantees that he has the right to communicate and disseminate them, freeing the Data Controller from any liability towards third parties.

  5. PURPOSE OF THE PROCESSING AND MANDATORY OR OPTIONAL NATURE OF THE PROVISION OF DATA

    D.M.A. IMMOBILIARE SRL informs users of the Site that the data collected will be used exclusively for the purposes specified below, with specific consent where necessary:

    1. fulfill legal, accounting and tax obligations;
      The provision of user data for the purposes listed above (a) is mandatory, their failure to provide them would not allow D.M.A. IMMOBILIARE SRL to satisfy the obligations established by law, by a regulation or by community legislation.Please note that pursuant to art. 24, paragraph 1, lett. a, of the Privacy Code, it is not necessary to consent to the processing of the user’s personal data for this purpose.
    2. execute contracts for the sale of products or assignment for the provision of services (supply of goods or services);
      The provision of user data for the purposes listed above (b) is optional, but failure to provide them could make it impossible to fulfill the contract or provide the requested services.
      Pursuant to art. 24, paragraph 1, lett. b, of the Privacy Code, we do not request the user’s consent to the processing of his personal data for this purpose as such data are necessary to fulfill obligations deriving from a contract of which the user is a part and/or to fulfil, before the conclusion of the contract, to specific requests of the same.
    3. sending promotional communications. In accordance with the provision of the Guarantor Authority for the protection of personal data “Guidelines on promotional activities and the fight against spam – July 4, 2013 n. 330”, D.M.A. IMMOBILIARE SRL will collect, for the purpose of implementing the need to simplify the obligations connected to the processing of personal data, a single consent for this purpose. If the user decides to give his consent to receive information relating to promotional activities, including market research by D.M.A. IMMOBILIARE SRL, these activities may be exercised, as required by current regulations, by means of telephone contacts via an operator (“traditional methods”), e-mail and the possible use of social networks (“automated methods”).
      The provision of user data for the purposes listed above (c) is optional and requires the user’s prior consent. At any time, the user may decide to revoke the consent previously issued by traditional or automated means by communicating it to D.M.A. IMMOBILIARE SRL without any formalities by writing to  info@casalenelbosco.it.
    4. (i). Profiling treatments may also be implemented (defined as treatments “aimed at defining the profile or personality of the interested party, or at analyzing consumption habits or choices”, see art. 37, paragraph 1, letter d) , of the Privacy Code) necessary for the provision of the Service and therefore exempt from consent.

      (ii). D.M.A. IMMOBILIARE SRL also reserves the right to implement profiling treatments that are not necessary for the provision of the Service – for example for promotional purposes – subject to the prior consent of the interested party.

      (iii) D.M.A. IMMOBILIARE SRL reserves the right to share the data acquired with selected commercial partners for carrying out marketing operations and professional activities related to particular initiatives, promotions and/or contests.
      The granting of (if any) consent to the processing of data for the purpose of profiling referred to in letters d).(ii) and d).(iii) above is optional. In the absence of this consent, there will be no consequences for the user with respect to the use of the service.

    5. on the occasion of promotional events and trade fairs, disseminate on D.M.A. IMMOBILIARE SRL the images of the participants collected there through photographs or videos.

  6. PROCESSING METHODS FOR WHICH THE DATA ARE INTENDED

    The user’s personal data is made available and processed by persons expressly authorized by D.M.A. IMMOBILIARE SRL, by its subsidiaries and/or subsidiaries, as well as by other companies referable to it and/or its shareholders, appointed for this purpose as data processors, limited to the pursuit of the purposes specified above.
    Specific security measures are observed to prevent data loss, illicit or incorrect use and unauthorized access in full compliance with the provisions of articles. 31 and following of the Privacy Code and the Technical Regulations – Annex B to the Privacy Code – regarding minimum security measures.

  7. SUBJECTS OR CATEGORIES OF SUBJECTS TO WHOM THE PERSONAL DATA MAY BE COMMUNICATED OR WHO CAN GET KNOWLEDGE OF THE DATA AS MANAGERS OR IN CHARGE OF THE TREATMENT, AREA OF DISSEMINATION OF THE SAME DATA AND POSSIBLE TRANSFERS OF DATA OUTSIDE THE EU

    The personal data that will be entered by the user will be known and used by the employees of D.M.A. IMMOBILIARE SRL and its investees and/or subsidiaries, as well as other companies referable to it and/or its shareholders for the sole purpose of carrying out the activities that constitute the reason for which the data were collected (for example, to carry out to sales contracts or for the provision of services or for sending newsletters, etc…).

    The data may also be communicated to research bodies or companies, non-profit associations or foundations, in this case only in anonymous form.

    The data may also be shared with selected commercial partners, for marketing purposes and professional activities related to particular initiatives, promotions and/or competitions, subject to the consent given by the interested party, as indicated in point 3 lett. d) (iii).

  8. RIGHTS OF THE INTERESTED PARTY. IDENTIFICATION DETAILS OF THE HOLDER AND, IF APPOINTED, OF THE RESPONSIBLE FOR TREATMENT. INDICATION OF THE METHODS THROUGH WHICH THE UPDATED LIST OF MANAGERS IS EASILY KNOWLEDGEABLE.

    Pursuant to art. 7 of the Privacy Code,

    1. The interested party has the right to obtain confirmation of the existence or not of personal data concerning him, even if not yet registered, and their communication in an intelligible form.
    2. The interested party has the right to obtain the indication:
      1. of the origin of the personal data;
      2. of the purposes and methods of the treatment;
      3. of the logic applied in case of treatment carried out with the aid of electronic instruments;
      4. of the identification details of the owner, of the managers and of the designated representative pursuant to article 5, paragraph 2;
      5. of the subjects or categories of subjects to whom the personal data may be communicated or who can learn about them as designated representative in the territory of the State, managers or agents.
    3. The interested party has the right to obtain:
      1. updating, rectification or, when interested, integration of data;
      2. the cancellation, transformation into anonymous form or blocking of processed data, including data whose retention is unnecessary for the purposes for which the data were collected or subsequently processed;
      3. the attestation that the operations referred to in letters a) and b) have been brought to the attention, also as regards their content, of those to whom the data have been communicated or disseminated, except in the case in which this fulfillment proves impossible or involves the use of means manifestly disproportionate to the protected right.
    4. The interested party has the right to object, in whole or in part:
      1. for legitimate reasons, to the processing of personal data concerning him, even if pertinent to the purpose of the collection;
      2. to the processing of personal data concerning him for the purpose of sending advertising material or direct sales or for carrying out market research or commercial communication, also by third parties.
